Terms of Service

Please read these Terms of Service ("Terms") carefully. By using movement3golf.com (the "Site") or any services offered through it, you agree to be bound by these Terms.

1. Who we are

Movement 3 Golf LLC is an Illinois limited liability company operating a golf instruction studio in Highland Park, Illinois. The Site is the online presence of M3G and provides information about M3G's programs, coaching services, and Rick Silva, PGA.

Membership services (PAR, BIRDIE, TOUR) are governed by a separate signed Membership Agreement. These Terms govern general use of the Site; they do not replace the Membership Agreement for members.

2. Eligibility

You must be at least eighteen (18) years old to enter into a Membership Agreement or purchase paid services. Individuals under 18 may participate in coaching only with a parent or legal guardian's written consent and on-premises presence during initial sessions as required.

3. Use of the Site

You agree to use the Site only for lawful purposes and in a manner consistent with these Terms. You agree not to:

  • Attempt to gain unauthorized access to any portion of the Site
  • Interfere with the Site's normal operation
  • Copy, reproduce, or redistribute Site content for commercial purposes without written consent
  • Use automated tools to collect information from the Site without written permission
  • Misrepresent your identity when submitting forms, testimonials, or communications

4. Intellectual property

All content on the Site — text, images, video, logos, the M3G name and mark, "The Golfer's Tools" book excerpts, biomechanical illustrations, and all coaching methodology descriptions — is the property of M3G or Rick Silva, or is used under license. You may not reproduce, republish, or redistribute this content without prior written consent.

You may share individual Site pages via social media or link to them from your own site.

5. Booking and payments

  • À la carte studio sessions and initial evaluations are booked and paid through Booksy, our third-party appointment platform. Booksy has its own terms of service and privacy policy which govern those bookings.
  • Memberships are enrolled through a signed Membership Agreement and billed through Square, Inc. Payment terms are governed by the Membership Agreement and Payment Policy.
  • Remote coaching is delivered through OnForm. OnForm has its own terms and privacy policy which govern that service.

Your use of Booksy, Square, and OnForm is subject to those third-party terms in addition to ours. M3G is not responsible for the practices of those third-party services.

6. Testimonials and reviews

Reviews, testimonials, and social media mentions of M3G reflect the individual experience of the person providing them. Results vary based on the individual, their commitment, their physical starting point, and many other factors. M3G does not guarantee any specific improvement in handicap, score, or ball-flight outcomes.

7. Coaching outcomes and no guarantee of results

Golf instruction is a collaborative process. Improvement depends on the student's practice, physical condition, equipment, and application of coaching between sessions. M3G does not guarantee any specific outcome — including handicap reduction, tournament results, or professional advancement — from its coaching services. Any historical or anecdotal results shared on the Site or by Rick Silva are illustrative, not predictive.

8. Physical activity and health

Golf instruction involves physical activity. By using M3G's services, you represent that you are physically able to safely participate. You agree to inform Rick Silva of any material medical conditions, injuries, or physical limitations before your first session and any time your condition changes materially thereafter.

9. Third-party links

The Site may link to third-party websites (Amazon, GOLF.com, Golf Digest, TrackMan, GEARS, TPI, Foresight Sports, OnForm, and others). M3G is not responsible for the content, accuracy, or practices of third-party sites and does not endorse any third-party product or service unless explicitly stated.

Some links may be affiliate links, meaning M3G may earn a small commission if you make a purchase through them. Any such affiliation is disclosed in the specific link.

10. Disclaimer of warranties

The Site is provided "as is" and "as available." M3G makes no warranties, express or implied, about the accuracy, completeness, or reliability of Site content. To the fullest extent permitted by law, M3G disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by Illinois law, M3G, Rick Silva, and their affiliates, employees, and contractors shall not be liable for indirect, incidental, consequential, or punitive damages arising from your use of the Site or M3G's services. M3G's total aggregate liability for any claim arising under these Terms shall not exceed the amount you have paid to M3G in the twelve months preceding the claim.

This limitation does not apply to liability that cannot be excluded under applicable law, including liability for gross negligence, willful misconduct, or personal injury caused by M3G's direct wrongful acts.

12. Indemnification

You agree to indemnify and hold harmless M3G, Rick Silva, and their affiliates from any claim, loss, liability, or expense (including reasonable attorney fees) arising from (a) your violation of these Terms, (b) your misuse of the Site, or (c) your infringement of any third-party rights through your use of the Site.

13. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws principles. Any dispute arising under these Terms shall first be addressed through good-faith discussion. If unresolved after thirty days, the dispute shall be submitted to binding arbitration in Cook County, Illinois, under the rules of the American Arbitration Association. Each party bears its own attorney fees except as an arbitrator may otherwise award.

14. Changes to these Terms

M3G may update these Terms from time to time. Material changes will be indicated by an updated Effective Date at the top of this page and, where possible, by notice on the Site. Your continued use of the Site after changes means you accept the updated Terms.
